Terms of Service

1. Acceptance of Terms

By accessing or using Spiceform (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Service.

2. Description of Service

Spiceform is a SaaS platform providing AI-powered form creation, data collection, and marketing automation tools. We reserve the right to modify or discontinue features at any time.

3. User Accounts

You must be at least 18 years old to use the Service. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. AI Disclaimer

Our Service utilizes Artificial Intelligence. You acknowledge that AI-generated content (forms, analytics, suggestions) may contain errors or inaccuracies. You are responsible for reviewing and verifying all AI-generated output before using it publicly.

5. Acceptable Use

You agree not to use Spiceform, directly or through forms, automations, subdomains or any other content you publish, to:

  • Engage in phishing, fraud, scams, or any other deceptive or illegal activity.
  • Impersonate any person, company or organization, or misrepresent your identity or affiliation, including by using a third party's name or trademark in a form, subdomain or URL.
  • Collect payment card information other than through the payment integrations we provide.
  • Send spam or other unsolicited messages.
  • Violate any applicable law or regulation, including privacy, data-protection and consumer-protection laws.
  • Circumvent an enforcement action, including by opening another account.

6. Enforcement and Verification

We may review content published through the Service. If we reasonably suspect that an account or form violates these Terms, we may, without prior notice:

  • Disable a form or stop it from accepting responses.
  • Suspend publishing, automations or subdomains, or suspend or terminate the account.
  • Require you to verify your identity and the legitimacy of your use (for example, an organizational email address, website or business registration) before a form or account is restored.
  • Restrict access to, or export of, responses collected through a form in violation of these Terms.

We will tell you what action we took and how to appeal, unless doing so would compromise an investigation or the safety of others. Fees are not refunded for accounts suspended for violating these Terms, except where the law requires it.

7. Reporting and Cooperation

We may preserve records and disclose information about accounts and content to law enforcement, regulators, respondents affected by a violation, and any person or organization that was impersonated, where we believe in good faith that this is necessary to prevent fraud or harm, or is required by law.

8. Your Forms and Respondent Data

You are solely responsible for the content of your forms and for the data they collect ("Respondent Data"). You act as the controller of Respondent Data: you must have a lawful basis to collect it and give respondents any notices the law requires. Spiceform processes Respondent Data on your behalf. Forms are published by their owners, not by Spiceform, and Spiceform does not endorse or verify them.

9. Indemnification

You agree to indemnify and hold harmless Spiceform and its officers and employees from any claims, losses, fines and expenses (including reasonable legal fees) arising from your forms, your collection or use of Respondent Data, or your violation of these Terms or of any law.

10. Payments and Refunds

Payments are processed by our authorized Merchant of Record (MoR). By purchasing a subscription, you agree to the MoR's Terms of Service. Subscriptions automatically renew unless canceled. Refunds are handled at our sole discretion or as required by law.

11. Intellectual Property

You retain ownership of Respondent Data. Spiceform retains all rights, title, and interest in the Service, including our code, design, and AI workflows.

12. Limitation of Liability

To the maximum extent permitted by law, Spiceform shall not be liable for any indirect, incidental, special, or consequential damages (including lost profits or data) arising from your use of the Service. Our total liability to you for any damages shall not exceed the amount you have actually paid us for the use of the Service in the 12 months preceding the claim. If you have not paid us any amounts, our liability to you shall be zero.

13. Governing Law

These Terms shall be governed by the laws of the State of Israel, without regard to its conflict of law provisions. Any disputes shall be resolved in the competent courts of Tel Aviv-Yafo.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or within the Service at least 14 days before they take effect, unless a change is required by law or addresses abuse of the Service, in which case it takes effect immediately. Continued use of the Service after a change takes effect means you accept the updated Terms.
